TERMS AND CONDITIONS

  • OWNER’S RESPONSIBILITIES:
    The Owner shall supply necessary water, gas, sewer, and electrical utilities unless otherwise agreed to in writing. Electricity and water at the job site are required. The Owner agrees to provide Vision Mechanical Inc. and its equipment full access to the property. The Owner is responsible for having sufficient funds to comply with this agreement. This is a cash transaction unless otherwise specified. The Owner shall remove or protect any personal property. Vision Mechanical Inc. is not responsible for damage to carpets, drapes, furniture, driveways, lawns, shrubs, or other property. The Owner will identify and warrant the property lines to Vision Mechanical Inc.

  • FEES, TAXES, AND ASSESSMENTS; COMPLIANCE WITH LAWS:
    All taxes, permits, fees, and assessments shall be paid by the Owner. Vision Mechanical Inc. will obtain any required building permits at the Owner’s expense. Upon request, the Owner shall provide sufficient funds to acquire required permits promptly. The Owner is responsible for paying assessments and charges imposed by public entities or utilities, including for sewers, water, schools, and hookups. Vision Mechanical Inc. shall comply with all applicable federal, state, and local laws and regulations.

  • LABOR AND MATERIAL:
    Vision Mechanical Inc. shall pay all valid charges for labor and materials used in the project. This obligation does not apply if the Owner fails to make required progress payments. Any waiver or release of mechanic’s lien is not binding until all payments due at that time are received.

  • DESTRUCTION OF WORK AND INSURANCE:
    If the project is damaged or destroyed by accident, disaster, or calamity (e.g. fire, storm, earthquake, flood, vandalism), any rebuilding or repair performed by Vision Mechanical Inc. shall be considered extra work and billed accordingly. Vision Mechanical Inc. carries Workers’ Compensation Insurance for its employees. The Owner is responsible for insuring their own property and any persons under their control on the job site.

  • INSURANCE AND DEPOSITS:
    Before work begins, the Owner shall procure, at their expense, “all risk” insurance covering vandalism and malicious mischief in an amount at least equal to the contract price, naming Vision Mechanical Inc. and subcontractors as additional insured. If the Owner fails to provide such insurance, Vision Mechanical Inc. may, but is not required to, obtain it at the Owner’s expense.

  • PAYMENTS AND RIGHT TO STOP WORK:
    Past-due payments shall bear interest at 1.5% per month (18% per annum) until paid. Vision Mechanical Inc. has the right to stop work if payment is not made when due. Work will remain stopped until all payments are received. Failure to make timely payment is a material breach of this agreement.

  • CLEAN-UP:
    Vision Mechanical Inc. will remove debris and surplus materials created by its work and leave the job site in a neat, broom-clean condition.

  • LIMITATIONS:
    No legal action arising from this contract or its performance shall be brought by either party more than two (2) years after completion or cessation of work.

  • SUBCONTRACTS:
    Vision Mechanical Inc. may subcontract portions of the work to properly licensed and qualified subcontractors.

  • VALIDITY:
    If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  • LIMITED WARRANTY:
    Vision Mechanical Inc. warrants that all work performed will be completed in a good and workmanlike manner according to standard trade practices for a period of one (1) year from substantial completion. Manufacturer warranties for equipment, assemblies, and appliances shall apply where provided.

  • EXISTING CONDITIONS:
    Vision Mechanical Inc. will make reasonable efforts to match existing textures, colors, and finishes but cannot guarantee exact duplication of surfaces such as plaster, stucco, or paint.

  • ASBESTOS, MOLD, AND HAZARDOUS SUBSTANCES:
    The Owner represents that, to the best of their knowledge, the property does not contain asbestos, lead paint, mold, or other hazardous materials. Vision Mechanical Inc. does not test for or remediate such substances unless expressly included in the Scope of Work. If discovered, work shall cease until the Owner hires a qualified abatement contractor. This will be treated as extra work, and the schedule may be delayed.

  • STANDARDS OF MATERIALS AND WORKMANSHIP:
    Unless otherwise specified in the Scope of Work, Vision Mechanical Inc. shall use standard or builder-grade materials. Vision Mechanical Inc. is not responsible for restoration or repair of areas outside the scope of contracted work, including landscaping, paint, flooring, or decorative finishes.

  • DELAYS AND MATERIAL COST INCREASES:
    Vision Mechanical Inc. shall not be liable for delays caused by events beyond its control, including acts of God, inclement weather, strikes, supply chain issues, inspection delays, or Owner-related actions. If material costs increase by more than 10% after contract execution, Vision Mechanical Inc. is entitled to an equitable contract price adjustment reflecting the increase.

  • RIGHT TO CURE:
    If the Owner believes any work is defective or incomplete, the Owner must provide written notice and allow Vision Mechanical Inc. ten (10) days to begin corrective action before pursuing any other remedy.

  • MECHANIC’S LIEN WARNING:
    Anyone who helps improve your property but is not paid may record a mechanic’s lien against your property. Even if you pay the contractor in full, unpaid subcontractors or suppliers may record liens and seek foreclosure. To protect yourself, request Preliminary Notices and consider making payments via joint checks.

  • VERBAL OPT-IN

Vision Mechanical Inc. will be collecting opt-in verbally from their customers. The customers will be able to opt in to receive messages either in person at their physical location, or over a phone call if the customer calls. When a customer is registered for the first time, they are asked to provide the phone number, and staff is trained to ask If the customer would like to opt in to SMS-based billing notifications, appointment reminders, dispatch notifications and job completion surveys. They will be verbally informed that "Message and data rates may apply", "Message frequency may vary", and they can "text HELP for support or more information and STOP to unsubscribe at any time and no further messages will be sent." They will also be informed that their information will not be shared with third parties. 

  • WEBSITE/ONLINE OPT-IN

By submitting this form and signing up for texts, you consent to receive text messages from Vision Mechanical Inc.  at the number provided, including messages sent by auto-dialer.   • RELEASE:
    Upon satisfactory payment for any portion of work, Vision Mechanical Inc. shall provide an unconditional release of mechanic’s lien rights for that portion of work as required by California Civil Code §§ 8400–8404.
